Surrogacy for Intended Parents

April 9, 2026 at 8:15:00 AM

For intended parents, the legal side of surrogacy can feel like the most unfamiliar part of your surrogacy journey. Terms like pre-birth order, parentage order, and parental rights in surrogacy often come up early in research, yet they are not always clearly explained in traditional parenting resources.

Understanding how legal parentage is established helps intended parents move through each stage with clarity. The legal process for gestational surrogacy follows a clear sequence, and this guide covers what to expect at each stage. This guide will walk you through what a pre-birth order is, why it matters, and what you can expect along the way.

Why Intended Parents Need a Pre-Birth Order

A pre-birth order is a court-issued parentage order legally establishing the intended parents as the child’s legal parents before the baby is born. It takes effect at the moment of birth. This legal step ensures that parental rights in surrogacy are formally recognized from the moment of birth. This provides clarity and protection as you prepare to welcome your child.

This order serves two essential functions. First, it directs the hospital to release the baby directly to the intended parents at discharge, without ambiguity or delay. Second, it instructs the state’s Office of Vital Records to place the intended parents’ names on the birth certificate from the outset. This simplifies the birth certificate surrogacy process and avoids the need for later corrections.

In states with comprehensive surrogacy frameworks, a pre-birth order can apply to any intended parent, whether an individual or a couple, regardless of marital status, sexual orientation, or genetic connection. Eligibility requirements vary by state, and a surrogacy attorney can confirm what applies in your jurisdiction.

Within the field of reproductive law, pre-birth orders are considered the gold standard for establishing legal parentage because they provide clarity and peace of mind before the baby arrives. In some states, a post-birth order is required instead. The ultimate legal result is the same, but the process differs: in post-birth-only states, the surrogate may initially appear on the birth certificate, requiring an amended certificate rather than an original one listing the intended parents.

The Legal Process for Establishing Parental Rights

The process of securing a pre-birth order follows a structured sequence within the broader gestational surrogacy legal process. While details may vary slightly by jurisdiction, the overall structure remains consistent and is designed to protect all parties involved.

  • Engaging a Reproductive Attorney

Intended parents work with a surrogacy attorney who specializes in reproductive law. This legal professional guides the parentage order process and ensures all filings meet state-specific requirements. Growing Generations can help connect you with surrogacy attorneys experienced in reproductive law.

  • Finalizing the Gestational Carrier Agreement

The gestational carrier agreement must be completed and signed before embryo transfer takes place, well before any legal filings begin. This document outlines roles, expectations, and responsibilities throughout the journey and serves as a key foundation for establishing parental rights.

  • Pregnancy Confirmation and Timing

Once pregnancy is confirmed, the attorney begins preparing the pre-birth order petition, with the process typically initiated in the early second trimester. Timing is important, as the goal is to have the order in place at least two months before the due date to account for the possibility of an early delivery.

  • Providing Medical Documentation

As part of the filing, the court requires a physician affidavit from the fertility clinic confirming that an embryo transfer occurred. This documentation supports the legal framework of the case and verifies the gestational surrogacy process.

  • Filing the Petition with the Court

With all documentation in place, the surrogacy attorney files a petition with the court requesting the pre-birth parentage order. This filing formally initiates the legal recognition of the intended parents.

  • Court Review and Issuance of the Order

In many cases, a hearing is not required. The judge reviews the submitted materials and issues the pre-birth order, legally establishing the intended parents as the child’s parents prior to birth.

In many states, after the birth, the surrogate signs a brief document acknowledging she is not the legal parent, reinforcing the parentage order already in place. Requirements vary by jurisdiction.

Why State Laws Matter in Surrogacy

One of the most common questions intended parents have is whether a pre-birth order will be available to them. The answer depends on state-specific surrogacy laws, which can vary across the United States.

Not every state allows pre-birth orders. Some require a post-birth order, while others may use a combination of both depending on the circumstances. New York and Washington have enacted inclusive surrogacy legislation, though both frameworks are relatively recent (Washington's law took effect in 2019 and New York's in 2021) and state-specific requirements such as residency rules may apply.

In states with less defined surrogacy laws, additional steps such as a post-birth order, second-parent adoption, or stepparent adoption may be required. While these processes are effective, they differ in timing and structure.

This is where thoughtful planning becomes essential. At Growing Generations, we take this into account during the matching process, helping ensure the matching process accounts for the legal requirements of your jurisdiction. Matching with a surrogate in a jurisdiction that supports your specific legal pathway is a core part of our surrogate matching process.

Getting Documentation in Order Before the Birth

As your journey progresses, preparing documentation in advance helps ensure that everything moves forward seamlessly. While the process may sound complex at first, it becomes much more manageable when guided by an experienced team.

Intended parents can generally expect to provide the following:

  • Government-issued identification

  • The fully executed gestational carrier agreement

  • A physician affidavit from the fertility clinic confirming the embryo transfer

  • Evaluations completed during the matching process

Securing a pre-birth order involves coordination between your surrogacy attorney, the fertility clinic, and the hospital where the birth will take place. Each plays a specific role in ensuring that the legal and medical documentation aligns. It is also important to notify the hospital of your pre-birth order in advance, ideally during the third trimester, so that staff are prepared to follow it at the time of delivery and discharge.

Exact requirements can vary by state and court, but this provides a clear picture of what to expect generally. Your surrogacy attorney will guide you through the specific details relevant to your case. Throughout this process, Growing Generations offers support by helping you understand what conversations to have, with whom, and when, so each step stays organized.
