Is Surrogacy Legal in New York?

Yes, gestational surrogacy is legal in New York. The passage of the Child-Parent Security Act (CPSA) in 2021 legalized compensated gestational surrogacy and established detailed protections for everyone involved in the surrogacy journey.

The Surrogates’ Bill of Rights, the first of its kind in the United States, guarantees every gestational carrier:

  • The right to make independent medical decisions throughout the pregnancy, including decisions about her health and course of care

  • Separate legal counsel, paid for by the intended parents

  • Comprehensive health insurance during the pregnancy and up to a full year following delivery

Growing Generations has supported intended parents from New York for decades. Before the CPSA, families worked with us by completing steps like embryo transfer, surrogate matching, and delivery outside New York, all while receiving the same personalized guidance from our team throughout. New York is also home to a number of highly respected IVF clinics, and we’ve built working relationships with several of them over the years to support our New York intended parents locally.

Today, New York offers a legally secure environment for gestational surrogacy, one where intended parents can build their families supported by protective laws.

Finding a Surrogate in New York

Finding the right surrogate is one of the most important parts of your surrogacy journey. For intended parents pursuing surrogacy in New York, we match you with surrogates who live in surrogacy-friendly states. Our surrogates are among the top 2% of all qualified candidates and are thoroughly screened through medical evaluations, background checks, wellness assessments, and in-depth interviews. With a 99.4% success rate and 98% of intended parents matching with their first surrogate, we help intended parents move forward with confidence — feeling informed, supported, and cared for at every step of the journey. Here’s what the process is like step-by-step:

Your New York surrogacy journey begins with a complimentary consultation. A Growing Generations client specialist will walk you through our surrogacy programs, surrogate and egg donor pools, and costs — and take time to understand your expectations, priorities, and timeline.

When you are ready to move forward, you will sign a retainer agreement and pay a retainer fee. This can be completed at any point — including during your initial consultation — and formally opens your file so we can begin matching.

Growing Generations matches intended parents with surrogates from the top 2% of all applicants, each thoroughly screened before you ever review a profile. Our Surrogate Match Guarantee covers up to $5,000 in screening expenses if your surrogate does not pass medical or wellness screening, and provides a free rematch at no additional agency fee. Once a match is identified, a Growing Generations team member facilitates a match meeting by video conference.

After matching, your surrogate begins additional medical preparation ahead of the embryo transfer. You will also begin funding your Growing Generations expense account at this stage. Your dedicated case specialist remains your point of contact throughout.

As the pregnancy enters its second trimester, Growing Generations coordinates delivery preparation with you, your surrogate, and the hospital team. Depending on where you are based relative to your surrogate's location in the United States, travel planning — including overnight arrangements — begins well in advance of your due date.
